Terms and Conditions for SafeNest

1. Definitions

Parent/Guardian: A legal adult (18+ years) who subscribes to and operates the SafeNest service.
Child: A minor (under 18 years) whose device is monitored through SafeNest.
Service: The SafeNest parental control application, including features such as app usage monitoring, location tracking, and WhatsApp integration.
Subscription: A paid plan granting access to SafeNest services for a specified period.
Data: Information collected, processed, or stored by SafeNest, including device details, location history, and usage statistics.

2. Acceptance of Terms

By accessing or using SafeNest, you:

  • Confirm that you are a legal adult (18+ years) and resident of India.
  • Agree to comply with all applicable laws, including the Information Technology Act, 2000 and DPDP Act, 2023.
  • Acknowledge that violating these Terms may result in account termination or legal action.

3. User Accounts

3.1 Registration

  • Parents/Guardians must provide accurate information during registration, including full name, valid email address, and active WhatsApp number.
  • False or misleading information may lead to account suspension.
3.2 Subscription
  • One subscription permits monitoring of one child device.
  • Each additional child device requires a separate subscription.
  • Subscriptions auto-renew unless canceled at least 24 hours before the billing cycle.
3.3 Account Security
  • Parents/Guardians are responsible for maintaining password confidentiality and promptly reporting unauthorized access.
  • SafeNest is not liable for losses due to compromised credentials.

4. Service Description

4.1 Features

  • App Usage Monitoring: Track installed apps, screen time, and usage patterns.
  • Location Tracking: Real-time and historical location data (stored for 30 days).
  • WhatsApp Commands: Send/receive alerts via WhatsApp number +91 83400 70071.
4.2 Limitations
  • Encrypted Apps: SafeNest cannot monitor encrypted content (e.g., WhatsApp messages).
  • Accuracy: Service reliability depends on device compatibility and internet connectivity.

5. Installation and Permissions

5.1 Requirements

  • Child Device: Android 8.0 (Oreo) or later, 2GB RAM, GPS enabled.
  • Parent Device: Android/iOS with WhatsApp installed.
  • Technical assistance is limited to guidance via email/WhatsApp (+91 91001 11666).
5.2 Permissions
  • Parents/Guardians must grant the following permissions on the child’s device: Location Access and App Usage Access.
  • Revoking permissions will disable monitoring features.

6. Child Privacy and Data Protection

6.1 Age Verification

  • Parents/Guardians must confirm the child’s age during setup.
  • Monitoring children under 13 requires explicit parental consent (DPDP Act 2023).
6.2 Data Handling
  • Collection: Limited to app usage, location, and device details.
  • Storage: Encrypted (AES-256) on Indian servers with defined retention periods.

7. WhatsApp Integration

7.1 Functionality

  • Commands (e.g., location requests) are processed via WhatsApp number +91 83400 70071.
  • Service depends on WhatsApp’s availability and policies. Delays may occur during WhatsApp outages.
7.2 Number Management
  • One WhatsApp number per account. Number changes allowed once per month.

8. Payments and Refunds

8.1 Subscription Plans

  • Monthly Plan: ₹299 per month, billed monthly.
  • Annual Plan: ₹2,999 per year, billed annually (save ₹589, equivalent to 2 months free).
8.2 Refund Policy
  • No refunds for partial subscription periods.
  • Exceptions apply under the Indian Consumer Protection Act, 2019.

9. User Responsibilities

9.1 Legal Compliance

  • Use SafeNest only for lawful monitoring of minors under your guardianship.
  • Do not monitor adults without explicit consent.
9.2 Device Management
  • Ensure the child’s device meets minimum requirements.
  • Do not tamper with SafeNest’s software or settings.

10. Liability and Disclaimers

10.1 Company Liability

  • No Warranty: SafeNest is provided “as is” with no guarantees of accuracy or uptime.
  • Exclusions: SafeNest is not liable for third-party app issues, data loss, or service interruptions.
10.2 User Liability
  • Parents/Guardians are solely responsible for misuse of monitoring data or unauthorized surveillance.

11. Termination

11.1 By SafeNest

  • Accounts may be terminated for violations of these Terms or illegal use of the Service.
11.2 By User
  • Cancel subscriptions via the app or email ([email protected]).
  • Data will be deleted within 48 hours of termination.

12. Dispute Resolution

Disputes will be resolved according to Indian law, with jurisdiction in Hyderabad courts. Arbitration will occur in Hyderabad, India.

13. Amendments

SafeNest may update these Terms periodically. Users will be notified via email/WhatsApp, with the updated Terms published on the website.
